Background

Austrian universities have
had the legal prerequisites in
place since 1 January 2004,
enabling them to commercially
exploit inventions and
developments independently. The
2002 Universities Act has
created the legal framework
that makes it possible for
universities to take up and
commercially exploit service
inventions at their
institutions.
|
To make use of this potential the
universities have to identify intellectual
property (IP) of commercial value, protect it
appropriately if a decision is made to take up
the IP and, finally, exploit it commercially,
e.g. by granting licences or starting up
spin-offs. In successful cases, the inventors
are given a share in the exploitation revenue
generated by inventions that are taken up.
Exploitation specialists (innovation scouts)
from the funding programme uni:invent at the
respective universities ensure that the
copyright activities described are processed
smoothly.
As part of the uni:invent
programme, CAST is responsible for the
identification and protection of intellectual
property at Innsbruck Medical University. If

If you are planning a scientific
project, you should first think about
possible inventions and protecting them
under patent law. That way you ensure
that inventions can be identified and
protected early on. We will help you
assess your research project under
patent law (search as to novelty,
market appraisals, etc.) and develop a
project plan with you that incorporates
protection of your inventions/research
results under patent law.

Evaluation of
inventions and technologies in terms of
patent law and profitability

We will check your publications
(scientific presentations,
dissertations, posters, database
entries, etc.) for patent-relevant
content and commercial exploitability
(searches as to novelty, exploitation
analyses, etc.).

to service regulations

We will advise and assist you in
aspects of patent law relating to your
research and collaboration contracts,
advise you on all property issues
concerning your inventions and help you
report service inventions.

implementation of strategies in regard of industrial property rights

strategy which, based on a cost/benefit
analysis, affords the greatest possible
protection against competition at
reasonable cost.

property rights and, if you wish, take
charge of their commercial exploitation
(spin-out, identification of potential
licensees, licensing negotiations,

At training events dealing with
industrial property rights, searching
patent databases (e.g. searches as to
novelty), licence law, etc., you will
have the opportunity to continuously

Searching patent
databases

Industrial property rights are
rights that enable the owner to
prohibit competitors from using
technologies. Industrial property
rights, in particular patent documents
and utility models, also serve as a
source of information for tracking
technological developments throughout
the world and identifying significant
developments for your own research
projects early on. We will help you
search patent databases to identify and
monitor research areas that are
important to you.
